2. Overview

We process personal data only to the extent necessary to operate this website and to respond to enquiries. This website is operated without cookies, analytics or other tracking technologies, and without content loaded from third-party servers, provided that this remains true after technical changes.

3. Hosting and server log files

This website is hosted by Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, United States, on servers located worldwide through Vercel's global content delivery network; our contact-form server function is configured for Frankfurt am Main, Germany (fra1). This configuration does not limit all hosting-related processing to Germany or the EU/EEA. When you visit the website, the server automatically records technical request data, which may include your IP address, the date and time of access, the page requested, the referring URL, and information about your browser and operating system. We process this data to deliver the website and to protect its security and stability (Art. 6(1)(f) GDPR), provided that this legal basis is appropriate for the actual configuration. Log files are deleted after 6 months unless they are needed to investigate a security incident or to establish, exercise or defend legal claims. Where the hosting provider processes personal data on our behalf, the relevant processing is governed by a data processing agreement under Art. 28 GDPR.

4. Enquiries via contact form or email

When you contact us, we process the information you provide: your name, email address, company or organisation, the relevant category, names of other parties involved, a description of your matter, your requested response time and, where applicable, a deadline.

Purpose and legal basis. We use this information to respond to your enquiry and, where applicable, to take steps at your request before entering into a contract (Art. 6(1)(b) GDPR), and/or on the basis of our legitimate interests in handling enquiries efficiently (Art. 6(1)(f) GDPR), as applicable to the specific processing. Before accepting an engagement, we may process relevant information to check for conflicts of interest in accordance with applicable professional obligations, including § 43a(4) BRAO and § 3 BORA. The precise legal basis, including any reliance on Art. 6(1)(c) GDPR, must be verified for the actual process.

Contact form. Our contact form is integrated into our website and hosted by Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, United States. When you submit an enquiry, our website processes the information you provide and transmits it through Microsoft 365 to our email address, contact@bantam.law.

Email transmission. Submissions made through the contact form are transmitted to us directly by email to contact@bantam.law. We do not use an AI-based tool to process, structure or summarise your enquiry; each enquiry is reviewed directly by one of our lawyers.

Please do not send confidential or particularly sensitive information before we have confirmed that we can act for you and, where necessary, provided instructions for a suitable secure communication channel.

5. Information about other parties

If you name other parties in your enquiry, we may process their names and other information you provide about them to conduct conflict checks and comply with applicable professional obligations, including § 43a(4) BRAO and § 3 BORA. The applicable legal basis under Art. 6 GDPR, and any additional requirements for special categories of personal data, must be assessed for the actual information and process. We do not inform these persons where this would conflict with our duty of professional secrecy or where a statutory exception applies (Art. 14(5)(d) GDPR, § 29(1) BDSG).

6. Retention

Enquiries that do not lead to an engagement are deleted after three months following our last communication, unless a longer period is necessary for conflict checks, legal obligations or the establishment, exercise or defence of legal claims. If an engagement follows, the data becomes part of the client file and is retained in accordance with applicable statutory retention periods, including, where applicable, § 50 BRAO and tax law.

7. Professional secrecy

As lawyers, we are subject to professional secrecy under applicable law, including § 43a(2) BRAO and § 203 of the German Criminal Code (StGB). Service providers that have access to confidential information must be carefully selected and appropriately instructed and bound to confidentiality in accordance with the applicable requirements, including § 43e BRAO.

8. Transfers outside the EU/EEA

We do not intentionally transfer personal data to countries outside the EU/EEA. If a transfer outside the EU/EEA occurs, we will update this notice and ensure that the applicable requirements for such a transfer are met.

9. Your rights

You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20), subject to the applicable statutory requirements and limitations. Where we process data on the basis of Art. 6(1)(f) GDPR, you may object at any time on grounds relating to your particular situation (Art. 21). These rights may be limited where statutory obligations, including duties of professional secrecy, apply (including § 29 BDSG). To exercise your rights, please write to contact@bantam.law.

You also have the right to lodge a complaint with a supervisory authority, for example the Berlin Commissioner for Data Protection and Freedom of Information (Berliner Beauftragte für Datenschutz und Informationsfreiheit).

10. Encryption

This website uses TLS encryption for data transmitted over connections that support TLS. The actual TLS configuration, including the contact form and any other transmission channels, must be verified before publication.
